Terms and Conditions


1. Purchase of Services

1.1. The Online Program (‘Program’) is operated by Becky Hughes t/a Bec Hughes (ABN: 30 056 159 867) of 6 Plantation Place, Wellington Point, QLD 4160 (‘Bec Hughes’).
1.2. The Coaching will be provided online in accordance with your chosen program duration as specified on the Program Information Page (‘Information Page’) and other documentation related to the Program.
1.3. The Program may include pre-recorded content, workbooks and group online coaching sessions, as specified on the Program Information Page (‘Information Page’) and other documentation related to the Program.
1.4. These Terms and Conditions are to be read in conjunction with the Program information page (‘Information Page’) on my Website.

2. Acceptance of the Terms

2.1 You accept these Terms by making your initial payment for either your first instalment or for the full period of the program in one lump sum as agreed, and these Terms will apply to all program related services thereafter.
            
3. Personal Information

3.1. When purchasing online Programs, you will be required to provide personal information such as your full name, business name, ABN, address and e-mail address.
3.2. You agree that all details that you have provided in completing the purchase are true and correct.
3.3. Your personal information is kept in accordance with the Bec Hughes Privacy Policy (‘Privacy Policy’).

4. Purchase of Online Programs 

4.1. In purchasing an online Program, you will agree to the payment of the Purchase Price listed on the Information Page of the website (bechughes.com)
4.2. Payment of the Purchase Price may be made via online check-out on the Teachable purchase page.
4.3. You acknowledge and agree that payment of fees is required within the payment terms specified, either monthly or in full prior to receiving pending Program content or coaching. Program availability will not proceed where fees are outstanding in relation to the Program.
4.4. Unless otherwise stated, all amounts are listed in Australian Dollars (AUD) and GST inclusive, which will be applied in line with requirements as defined in A New Tax System (Goods and Services Tax) Act 1999. Where the services are provided outside Australia, GST is inapplicable.

5. Payment Terms

5.1 Payment in full or for the first month, depending on your chosen payment plan, is required immediately on enrolment. For subsequent monthly payments, pending Program services will be paused if any fees are outstanding until payment is made. A late fee may be applied at a rate of 0.5% per day for all outstanding Program fees for everyday they are overdue.

6. Delivery of Program and Licence Information 

6.1. When You purchase the Program, Bec Hughes grants You a limited, revocable, non-exclusive, non-sub licensable, non-transferable license to access and use the specific Program and any related software, content, equipment or other materials for Your specific, non-commercial use only (the ‘Licence’).
6.2. The Program is intended for the business/individual listed on purchase and is not available or accessible to any other person or individual.  

7. Refunds 

7.1. The monthly or full payment is non-refundable. This means that if You wish to terminate Your involvement in the Program early, You will not receive a refund.
7.2. Bec Hughes will only provide You with a refund of the Fee in the event that Bec Hughes is unable to continue to provide the Services (the 'Refund'). 


8. Cancellation


8.1. The Program is provided within the period specified on the Information Page. When you pay your Program fee as per the purchase page that fee is non-refundable and all future monthly payments will be due as per the specified payment schedule.

9. Liability

9.1 Bec Hughes’ total liability arising out of or in connection with the Program or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the resupply of the Program to You.

10. Warranty Period for the Coaching

10.1 Bec Hughes will use their best efforts and take all reasonable steps to help You achieve the desired results. However, Bec Hughes makes no warranty that the Program will meet Your requirements or that all clients will achieve the same results. 
10.2 The Program comes with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the Program, You are entitled to cancel Your Program contract with Bec Hughes, and are entitled to a refund for the unused portion, or to compensation for its reduced value.

11. Copyright and Intellectual Property Rights

11.1. Intellectual Property Rights

(a) You agree that any works, documentation, materials, Program content, creative works or information of whatever nature produced or developed by Bec Hughes or under Bec Hughes' direction pursuant to or in the course of providing the Program will remain the sole and complete property of Bec Hughes, whether such property is tangible or is in the nature of industrial and Intellectual Property Rights (including copyright and rights of Confidential Information). 
(b) There is no assignment of Intellectual Property Rights by Bec Hughes to You pursuant to this Agreement.
(c) Nothing in this Agreement affects the Moral Rights in any works, items, materials or information supplied pursuant to this Agreement.

12. Indemnification

12.1 You hereby indemnify and agree to keep indemnified Bec Hughes against all liability, losses or expenses You incur in relation to or in any way directly or indirectly connected with any breach of copyright or any rights in relation to copyright in such literary and artistic works supplied as aforesaid.

13. Disclaimer

13.1 Bec Hughes does not guarantee revenue outcomes or other business outcomes through the use and involvement in the Program. You are solely responsible for creating and implementing Your own business, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the Program and interactions with Bec Hughes. As such, You agree that Bec Hughes is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any Program provided by Bec Hughes. 

13.2 The materials appearing in the Program or School may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the Program materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.


14. Information Disclaimer

14.1. Any information, advice, content or documentation provided through the Program, including in the associated blog, on the Website or on any other related platform do not constitute career, professional, financial, business or other advice, and are provided for general information and guidance purposes only. 
14.2. All care is taken in the preparation of the information and published materials in the associated blog, on the Website or on any other related platform. Bec Hughes does not make any representations or give any warranties about its accuracy, reliability, completeness or suitability for any particular purpose. 
14.3 To the extent permissible by law, Bec Hughes will not be liable for any expenses, losses, damages (including indirect or consequential damages) or costs which might be incurred as a result of the information being inaccurate or incomplete in any way and for any reason or Your reliance on the information, advice or documentation in the associated blog, on the Website or on any other related platform.

15. Mailing List Registration 

15.1. You will be registered for the Bec Hughes Mailing List (the 'Mailing List').
15.2. As part of the registration process, you may be required to provide personal information about yourself (such as identification or contact details), including:
     (a) Email address
     (b) Name
15.3. You agree to receive promotional material, updates and other content from Bec Hughes and can opt-out by unsubscribing at any time.

16. Governing Law & Jurisdiction

16.1. This Agreement is governed by the laws of Queensland, Australia.
16.2. In the event of any dispute arising out of or in relation to the Purchase Services or the Program, Bec Hughes agrees that the exclusive venue for resolving any dispute shall be in the courts of Australia, situated in Queensland, Australia.

17. Severance

17.1 Any provision of this Agreement which is prohibited or unenforceable in any jurisdiction will, as to such jurisdiction, be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions of this Agreement or affecting the validity or enforceability of such provisions in any other jurisdiction.

18. Public and Scheduled Holidays or Absences

18.1 Where standard Australian or Australian State holidays fall within the Program period, Program Sessions may be moved within the agreed Program duration at the discretion of Bec Hughes. Bec Hughes may also have scheduled or unscheduled periods of absence during the Program period and while every effort is made to inform You at the commencement of your Program, Bec Hughes reserves the right to delay or move Sessions as necessary. This will be confirmed at the earliest possible date. 


19. Bonus Services


19.1 Where discretionary bonus services are provided as part of the Program, they will be subject to all the of the same Terms contained within this document. You should refer to the email correspondence or information on the Information Page with regards to the terms for delivery or redemption of these services.


20. Marketing 

20.1 You agree that any testimonials that may be provided by You from time to time may be used by Bec Hughes for marketing purposes. 

21. Entire Agreement and Modifications

21.1 Both You and Bec Hughes confirm and acknowledge that these Terms and Conditions, Information Page, Payment Page and Website Terms and Condition of the Website constitute the entire agreement between You and Bec Hughes and shall supersede and override all previous communications, either oral or written, between the parties.
